A newspaper photographer who witnesses criminal activity and is later subpoenaed to testify in a criminal case does not have a qualified privilege to refuse to testify under the United States and Minnesota Constitutions, nor can the photographer refuse to disclose any unpublished photographs relating to the defendant's arrest. 2. The Free Flow of Information Act, Minn. Stat. Â§Â§ 595.021-.025 (1994), does not apply to a newspaper photographer who witnesses criminal activity, nor to unpublished photographs obtained by the newspaper, if disclosure of the photographer's testimony or the photographs would not tend to identify a confidential source.
